Destination Jiu-Jitsu’s Promotional Contests, Sweepstakes, and Giveaways General Rules

From time-to-time Destination Jiu-Jitsu, LLC (“Destination Jiu-Jitsu”, “DJJ,” “us,” “we,” “our”) conducts and you (“you,” or “your,”) may enter promotional contests, sweepstakes, and giveaways (collectively, the “Promotions”). At times, special Promotions may require the establishment of a separate set of rules. Our general Promotion rules are as follows and in effect unless otherwise indicated in the Promotion announcement:

  1. NO PURCHASE NECESSARY TO ENTER OR WIN.
  2. Unless otherwise indicated, Destination Jiu-Jitsu, LLC is the sole sponsor of all Promotions.
  3. All Promotions indicate the prize(s) to be awarded and the method of entry, which varies with each Promotion, but is clearly indicated in the Promotion announcement. Methods may include, but are not limited to: email, social media interaction, website entry, text entry, postcard entry, and printed entry blanks.
  4. When any Promotion has a deadline for entry, the deadline is clearly indicated in the announcement and any written rules. The date on which the winner will be determined is indicated in the announcement.
  5. The odds of winning will depend on the number of eligible entries received.
  6. Promotions are open to U.S. and Canadian residents ages 18 or older unless otherwise indicated. All federal, state and local laws and regulations apply. Void where prohibited by law. Employees of DJJ, its parents, subsidiaries, affiliates, advertising and promotion agencies, and the immediate family members of, and/or those living in the same household of each, are not eligible to enter.
  7. The retail value of the prize(s) offered is less than $5,000. Winners are responsible for all federal, state and local taxes, if any.
  8. The prize(s) offered will be awarded. No alternative gift, prize, cash, or other substitution is permitted except by DJJ in the event of prize unavailability. Prizes are non-transferable and are not negotiable. Prizes cannot be exchanged for cash. Limit one prize per family or household.
  9. You may only enter the Promotion once. Use of any robotic, automatic, programmed, or similar entry method or entering more than the number of times permitted will void all entries and result in disqualification. You may not enter more times than indicated by using multiple email addresses, identities, or devices in an attempt to circumvent the rules.
  10. You grant to DJJ, without limitation, and without additional financial or other compensation, the right to use your name, likeness, portrait, recorded voice and biographical material, in order to advertise, promote or publicize DJJ, its licensee, the Promotions, and any advertisers and co-sponsors associated with the Promotions and their products and services.
  11. DJJ reserves the right to amend or change the above rules at any time as well as end a Promotion at any time. All decisions of DJJ with regard to the awarding of prizes, the selection of winners, and the interpretation of these rules shall be final. You by virtue of entering the Promotion agree to accept the decision of the DJJ as final and agree to these rules.

  13. LIMITATION OF LIABILITY: By entering the Promotion, you waive all right to, and hold Destination Jiu-Jitsu, LLC and its affiliates, officers, directors, employees, agents, successors, and assigns harmless from, any claim, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees) arising out of or in connection with participation in the Promotion or the acceptance, use, or misuse of any prize. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. DJJ and its affiliates, officers, directors, employees, agents, successors, and assigns will not be responsible for: late, incomplete, or incorrect entries; and your failure to receive prize notices due to your spam, junk e-mail, or other security settings or for your provision of incorrect or otherwise non-functioning contact information; technical, hardware, or software malfunctions, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or used in the Promotion; by any human error which may occur in the processing of the entries in the Promotion; or any typographical, technological, or other error in the publishing of the offer, administration of the Promotion, or announcement of the prize(s). If, in the DJJ’s opinion, there is such an error, or there is any suspected evidence of tampering with any portion of the Promotion, or if technical difficulties (including viruses and bugs) compromise the integrity of the Promotion, DJJ reserves the right to, in its sole discretion, cancel or modify the Promotion in a manner deemed appropriate by DJJ. In the event of termination, winners will be selected from among all eligible entries received as of date of termination. In the event a dispute arises as to the identity of a potentially winning entrant, entries will be declared made by the name on the online entry form.
  14. You agree that: (A) any and all disputes, claims, and causes of action arising out of or in connection with these Promotions, or any prize(s) awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of OhioTexas; (B) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event shall attorneys’ fees be awarded; and (C) under no circumstances will you be permitted to obtain awards for, and you herby waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of you and Destination Jiu-Jitsu in connection with the Promotion, shall be governed by, and construed in accordance with the laws of the State of OhioTexas, without giving effect to any choice of law or conflict of law rules or provisions (whether the State of OhioTexas or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than the State of OhioTexas.
  15. By submitting an email address you agree to have that email address added to the Destination Jiu-Jitsu newsletters. You may remove yourself from any DJJ newsletter via the unsubscribe link at the bottom of any DJJ newsletter email. Unsubscribing from the DJJ newsletters does not affect your eligibility for any Promotion. Your email address will only be used by Destination Jiu-Jitsu, its subsidiaries or affiliates for promotional or marketing purposes. Your information will not be sold or disclosed to third parties.
